Sorry Dr Haneef, your 15 minutes is nearly up
Terrorism laws - - Posted on July, 17 at 5:47 pm by Ken L
The government’s handling of the Haneef affair is being discussed at length elsewhere – LP has another good thread, as does Andrew Bartlett and Tim of course at Blogocracy – and there’s no point in me covering well-worn territory. However there are a few points that seem worth making before the story disappears from the public consciousness:
1. The AFP were completely justified in detaining and questioning Dr Haneef. People who are now suggesting otherwise are just being silly. However, making a great public announcement about it was unnecessary and quite possibly stupid, given the possibility that Haneef was part of a suspicious local network. The publicity right from the outset suggested that the government was going to milk this for every political advantage it could get.
2. On the AFP’s own account, Dr Haneef made a voluntary statement and there is no suggestion that he was associated with any planned terrorist activity here. This conclusion is strongly supported by the granting of bail. The magistrate must have been absolutely convinced that Haneef represented no possible threat to the community, and really underlined the point by setting it at the comparatively negligible figure of $10,000.
3. Now that Dr Haneef has been charged, he will simply have to hang around awaiting trial. He is not being ‘detained for questioning’, as some people still seem to think. The questioning is over and he’s been remanded pending the initial hearing. If the AFP want to ask him any more questions he’s perfectly within his rights to tell them to go jump, and indeed would be crazy not to.
4. It’s likely to be years before he is tried. The case against him will inevitably involve a lot of the evidence that the British authorities will use in the cases against the nutjobs who tried to set off the car bombs. I’m sure they wouldn’t make it available until it’s been used in the main event, meaning that Haneef is effectively stuck in limbo until the British trials have been completed.
5. That being the case, and Haneef posing no threat to the Australian public, cancelling his visa is an act of pure bastardry. Kevin Andrews’ sickeningly sanctimonious performance on last night’s 7.30 Report proved the previously unthinkable, namely that there are even more odious creeps in the federal cabinet than the Corpse Who Walks. If Andrews decided that Haneef deserved deportation why not wait until after the court case had finished to implement the decision? The terms of Haneef’s bail prevented him from going anywhere so this act of spiteful grandstanding serves no purpose other than to make sure the poor bastard gets locked up in miserable conditions for years. Of course it also presents a challenge to an incoming Labor Attorney-General to either endorse the decision or reverse it and cop immediate “Yeah just what we thought, soft on terror” accusations but Andrews wouldn’t be that petty would he?
I expect that the whole thing will fade quickly from public view now but there are a few outstanding questions that beg to be answered.
1. The alleged offence was committed in the UK. Why was Ruddock so eager to publicly rule out extradition? Have the British authorities requested Dr Haneef’s extradition? If they have, wouldn’t it be much more sensible to withdraw the charge here and allow the extradition proceedings to go ahead in the place where all the relevant witnesses are located? And if they haven’t, is the government seriously going to try a man for an offence committed in a country where the offence is supposed to have happened, even though the authorities in that country can’t be bothered? Either way, proceeding to deal with Dr Haneef under Australian law seems beyond ridiculous when his alleged offence concerns our Mother Country.
2. Forgetting the need to prove facts in court about this particular matter, are the government and the opposition both happy to endorse a law which could see someone locked up for 15 years for giving a SIM card to a family member who subsequently turns out to be a wannabe terrorist? In other words do they agree that this is a just law? And don’t try to avoid the issue with the usual crap about not responding to hypothetical questions; dealing with hypothetical situations is exactly what the anti-terrorism laws are supposed to be for. So do they agree or not?
3. What is Labor’s attitude to the law that lets the minister cancel visas on grounds related to ‘character’? it’s all very well for Tony Burke to say the minister has acted in accordance with the law but that’s not the important question … it’s whether Labor supports the law in the first place.
I don’t expect answers to these questions any time soon. But let’s keep asking them anyway, because with any luck the minor parties will regain the balance of power in the Senate next July, and we might see some scrap of accountability restored to government in this country.

Ken, you have said it all. There is no way that we can let this crap continue without comment and action - we need to ensure that everyone knows the story and understands the implications.
If the sheep are content to ignore it then so be it - let them be shorn and turned into ugg boots and lamb chops - they deserve it.
Actually, I don’t mind my fellow Australians being dumb - I just object to them being dumb around me. Lets export them to the USA - so they can support GWB and his crowd.
People - notice how you are being manipulated - you might want to read some books and engage with the world beyond channels 7, 9 and 10. Then again you may not.
July 17th, 2007 at 7:21 pm
As usual Ken you have asked all the questions that I am also thinking, many thanks for you comments.
Over at an on line opinion blog a contributor suggested that the Doctor is “a prospective terrorist supporter”, and I asked ,then why isn’t he in “prospective custody”.
Shows how the Howard approach still works for some, fear, mind you it’s wearing a bit thin, but, when your grasping at straws, I guess you drown all the same, maybe just a bit slower. ( Bloody hell, they are a distasteful lot)
With Rogers remark, and the situation in rural Aus; and doctors, this is bad news for us, we rely on over seas Doctors to keep us alive, and I can see a lot of grief down the road for us in the bush.
Further to Rogers remarks, if I see some dead lambs and then spot a dog, do I shoot the dog, go home shoot all the other dogs then run around trying to contain the flock?.
July 17th, 2007 at 7:51 pm
Ken,
Great post… but we really need to get some action going. We need to get people onto the streets.
The question is how?
July 17th, 2007 at 8:32 pm
It was eerie to note the similarities between Mal Brough’s and Kevin Andrew’s performances on the News and the 7:30 Report on the same day about two completely different matters.
As the French say ‘c’est pareil’.
Both were equally naseous.
July 17th, 2007 at 8:35 pm
if the height of yer imagination is to take to the streets, shouldn’t you be over a ‘getup’ painting placards?
July 17th, 2007 at 8:42 pm
Alfred if the link to your blog actually worked we might have a better idea of your proposals.
July 17th, 2007 at 8:48 pm
Alfred Loomis, retired, comfortable , not short of a quid, bored and run out of friends, discovered an annoying way to be annoying in secret, probably ignored at the local, and the Bowling Club, likes to stir the pot, first to arrive at the pooling booths to check out who’s doing what.
Always appreciate you sharp observations and droll wit, I hope you don’t find a more appreciative field than this one.
July 17th, 2007 at 10:05 pm
It takes all sorts to make a democracy Lang Mack. Loomis may be a one message man, but he’s one of us, in the sense that he’s the same species.
Great post Ken. Comments from all over the place suggest that Andrews might have bitten off more than even his gigantic gob can chew.
Yes, Labor could kick up a stink, but wouldn’t it be nicer to see Howard’s mob self immolate on this the same way they have on every other tactic they’ve tried so far?
July 17th, 2007 at 10:42 pm
Yep, good post.
The other disturbing aspect (there are so many) of this case is that he’s apparently being tried for something done by someone long after his interaction with that person. Unless new evidence comes to light that he knew his second cousins were planning acts of violence, this is effectively punishment for actions over which Haneef has no control, no knowledge and no responsibility.
The mind boggles and the conscience protests.
July 17th, 2007 at 10:49 pm
I suppose it would be open to an incoming Labor minister to ask to see the AFP evidence on which Andrews allegedly based his decision, and ask for the bits that weren’t aired in court to be highlighted. Then the whole thing could be opened to public scrutiny. Meanwhile, the good Dr Haneef’s wife threatens to capture public sympathy - she’s got excellent television presence. If I were advising her I’d be parading the baby, too.
Meanwhile, did anyone notice the reports that Haneef was brought into court barefoot and shackled? This is not normal Queensland criminal law practice. It surely does give an insight into the mentality of the AFP, though… and a bit of credence to Hicks’s and Habib’s allegations about AFP participation in torture. I wonder if Tony Fitzgerald would be available for a Royal Commish into the AFP post-Howard?
July 17th, 2007 at 11:24 pm
I bet someone in Canberra has made irate phone calls demanding to know why he wasn’t in one of those orange suits they seem to reserve for terrorist-related offences.
July 17th, 2007 at 11:53 pm
Ken Says: 1. The alleged offence was committed in the UK. Why was Ruddock so eager to publicly rule out extradition? Have the British authorities requested Dr Haneef’s extradition? Lateline was interesting tonight. The guy Haneef gave the SIM card to, Sabeel Ahmed, was also a doctor and the brother of one of the Glasgow bombers. Sabeel has been charged with witholding information that might have prevented a terrorist attack, because he received an e-mail from his brother directing him to the location of his will. The British Police say that this was a suicide note, and Sabeel should have alerted authorities. Whatever the merits of this charge, it’s notable that Sabeel hasn’t been charged with being a terrorist or with being a member of a terrorist organisation. This suggests, of course, that the charges against Haneef are just complete and utter bullshit.
July 18th, 2007 at 12:02 am
Ruddock is on Lateline now, pushing the “secret evidence” line.
July 18th, 2007 at 3:44 am
Excellent piece Ken, per usual.
As I’ve warned previously, this is only one part of the jigsaw…the picture will eventually turn out to be a protracted war run by an alliance of totalitarian states in the guise of Democracies…characterised in Australia by compulsory National Service which will have been incrementally introduced by way of the Aboriginal community takeover (the use of the military could see the Government promoting a “shortage” situation & ramping up full bore a “recruitment drive” based on the need to stamp out juvenile delinquency…think of the medias role of late…certain TV shows…the same Moguls & Producers who played an implicit role in the “invest in a new home, then refurbish & go into deep debt” campaign ),the recent change to welfare commitments/policies (”we expect more for our dollar…how about doing some National Guard…cough, cough…I mean Community Service for your dole Laddy”) eventual Federal control of schools (access by recruiters USA style)…
…this lot are keen to resort to “the Gathering Storm” type comments in an attempt to convince the public that Islamic fundamentalism & terror organisations such as Al-Qaeda are exploding outwards at such a rapid pace it will not only be necessary for America to “stay the course” but that they & their allies will need to “dig in” & find extra troops & shift to an economic & citizenry “sacrifice” pose…using the Left’s discourse & strategy against it…heaps of ‘misdirection’ & Machiavellian stuff going on here.
The Dems demand for changes to troop “time back home” may in fact be a ruse by some War sympathizers to give the appearance they’re taking the ‘withdrawing’ troops stance…but in fact intend to play into the hands of the Neo-Cons who will declare ‘Martial Law’ when some devastating explosion goes off in a major city or two…& will be conveniently linked to Iran…just as the Surge begins to fail miserably…& a large group of American troops are ambushed…& the Fox Network & Bush admin scream ‘blue bloody murder’ at the Dems for having undermined the morale of soldiers & left them bereft of appropriate backup…
’cause let’s face it…Israel is keen to eliminate the Iranian risk to their existence…& MUST be using their influence in the Executive, Congress, the Media & Corporations to press the Americans to resolve the situation for them. It’s a bloody mess.
And Haneef is one part of a wider strategy…a Grand Plan…one evolving since Cheney & Rummy were in the White House back in the mid 70s…& Poppy Bush was CIA director. It’s even possible that this latest Russia/UK business is related to it.
Imagine if the sh*t hits the fan as outlined above…& the Federal Police & Attorney-General decide to pull in bloggers who might be inciting anti-military, anti-patriotic sentiment…undermining the ‘War Effort’…?…almost as spurious in nature as Haneef’s connections to his 2nd cousin’s actions. That’s a big concentration camp they’re building out there on Christmas Island.
July 18th, 2007 at 11:12 am
I listen to people condemning Paul Keating for his fiery ‘Film and art in the Australia of nationalism and cynicism’ speech, & I think FOOLS!.
John Howard is an extreme Nationalist prepared to turn this Country into a Military/Police State Nation. He’s taken us into overseas ventures that have become Fiascos. The craziest strategic maneuvers since the Vietnam War.
By God I’d luv to see Keating in charge right now instead of this blundering fool Howard…this CHARLATAN who purports to be honest but works w/ a propaganda-filled, Corporate Fascist media to spread FEAR, LIES & DECEIT.
Dividing our communities…constructing MORAL PANIC…
pointing to the children & indigenous…as tho they are potential maniacs…delinquents…criminals…out of control!!! (when all the reports I get tell a different story about the majority of today’s children…& most of the Aboriginal community)…
yes, there was a generation that received nothing but pap & glitz under Howard…they were blitzed by every conceivable piece of crap possible via the magazines, TV, advertising, radio (ever wonder why ‘family values’ Howard only made token efforts to censor the PAP?…expanded the role of the PAP makers & deliverers by loosening media rules?)…
…now, granted, some of these kids are damaged, have been neglected by the Federal Government…mental health, access to Higher Education & decent training (intentionally, just like the Aboriginal population & those in New Orleans) in order to manipulate them into more violent acts than we’ve seen previously…to stamp them w/ guilt & drive them into rampant consumerism & early parenting…so they become indebted Serfs…indoctrinated by Herr Howard & Herr Murdoch…who use the media to push a few buttons so some of these young adults will explode on the streets, in their houses right on time…
so News Ltd & the other Enablers can cry out “look!, see what the social welfare system has created!…monsters everywhere!!!…increase surveillance cameras…more police…bring the military in!!!…we need to protect THE HEIMAT!…the Homeland!”
Intentional negligence…a decade of manipulation…of looking the other way (just like the Australian Wheat Board scandal…& Post-Katrina…& 9/11)…& cutting support systems…INCREMENTALLY…in order to project the idea our society is in CHAOS. In need of a 1930s - 40s style rerun…National Service…”never hurt us, will do the kids good”. Then before ya know it…they’re off to Iraq, Afghanistan, Iran…sent by Howard’s WAR CABINET - does he really think we’re that stupid?.
Wow!…Spielberg is coming to QLD to make a WW2 film…splendid timing…& interestingly, the film AUSTRALIA also deals w/ that same era…conveniently. We’ve had TV shows on War-time Prime Ministers, Churchill, Fox Rugby ads that look strangely like they have the ANZAC sign in the background (very subtle)…an obsession w/ war memorials & war films…we’ve had Kokoda…the list goes on…media propaganda…media blitz…
Gawd forbid! if we actually looked at THE VIETNAM WAR instead…from an anti-war perspective.
Its called SOCIAL ENGINEERING my friends. Of the worst kind.
In the mid-late 90s a group of media moguls & radio jocks & politicians & CEOs conspired to bring down Clinton & Keating…eventually Gore…& bring about a New Reich. To construct a common enemy…we know them as Al-Qaeda.
Over time the definition of ‘common enemy’ has gradually expanded to include the Islamic Fundamentalist population…
Only a few knew of the Grand Plan. But it doesn’t take as many to change PERSPECTIVE & start a War as you think. But you must have Zealots…enormous Capital/Assets…& Influence…& a Propaganda Machine…a Military Structure that is biting at the leash…& Puppets in Government…& tinder…to fire up…

Yes, a lot of this is about wedging the Labor party, but it’s designed to do that now rather later. Who cares what a future coalition opposition thinks?
July 18th, 2007 at 1:57 pm
“But let’s keep asking them(Ken’s 3 questions) anyway, because with any luck the minor parties will regain the balance of power in the Senate next July, and we might see some scrap of accountability restored to government in this country.”
Jeez, I hope you’re right, Ken.
What happened to Hicks, and this latest bizarre Govt. behavior re Dr. Haneef has a sinister Orwellian air about it. The poor bastard has become an accidental “spiritual” son of Alex Solzhenitsyn.
That’s a wonderful burst of heartfelt Gonzo, Nasking. Ruddster’s response to recent events(if your big picture predictions are correct) indicates that he’s not gonna rock the boat.
With BushCo calling the big plays, we’ll know within 18 months(scheduled 08 election) how close to the money you are.
Meanwhile, festering cells of Al Kaeida are “regenerating” and “regrouping” on the Afghani/Pakistani border. Be very afraid. I’ve become quite agoraphobic. Might get wasted by an Evil Turrst or even hit with a meteorite if I venture outside, too far from the cosy reassurance of my treasured Aust.Govt. Issue fridge magnet.
Hope you get a good Gulag, man.
July 18th, 2007 at 2:56 pm
Wasn’t it lovely the way the rhetoric about courts and the rule of law (safeguards, nothing to worry about, he’ll have his day in court etc) changed the moment it went against them? Courts are fine, as long as they follow government instructions.
Just reading the news since Haneef’s arrest will tell you all you need to know about the fascist beasts that lie behind the smiling masks of Howard, the Corpse Who Walks and the rest of the ghastly crew. For some reason, though, some of the MSM seem to feel aggrieved this time. Doubtless they’ll be pulled into line before long.
Last, I wonder how the plot of the latest Harry Potter blockbuster will influence voters? A deceitful government, sinister deals being done to hoodwink the public, cliches instead of education…
July 18th, 2007 at 6:25 pm
Ken, I guess you will have, I was shocked to read on Margo K’s webdiary , David Davis on the transcript etc;.
July 18th, 2007 at 7:02 pm
I’m obviously not the only one who believes we can’t trust our Governments & that ’staged attacks’ are not out of the question in order to bring in a new draft/compulsory service…& that such ‘false flag’ events will be used as a reason for attacking Iran…& declaring Martial Law. But then, I’ve been reading articles from former Reagan official Roberts for awhile now…& he has helped put pieces of the jigsaw together:
http://www.infowars.com/articles/terror/false_flag_terror_bush_may_stage_event_to_reinstate_draft.htm
You might not agree w/ Paul Watson & Alex Jones’ more Libertarian views…they can be a bit harsh on gays & the Global Warming believers (incl. Gore)…but i reckon these guys are onto something. There’s a bit of Libertarian in most of us…at least those who detest Totalitarianism of all kinds, including Fascism, National Socialism (NAZIs), Communism.
July 18th, 2007 at 7:13 pm
Nasking, what a ripper of a post, but I think most of them will be too frightened to read it.It is not that they don’t want to read it but someone might see them and tell the secret police on them.I’ts definitely SOCIAL ENGINEERING alright but they would’nt believe that either just in case it might be true. But you will be proven to be right a little way down the track.Loved it!
July 18th, 2007 at 7:19 pm
Yeah nasking, don’t get me started on the bits of the 9/11 story that don’t add up unless someone on the inside had a hand in it…for some reason the very idea freaks a lot of people out and they go into a weird kind of cognitive dissonance “the consequences are too disturbing I don’t want to know it can’t be true therefore even the evidence must be disbelieved I can’t hear you I can’t hear you the government will protect us they must have our best interests at heart” kind of loop.
July 18th, 2007 at 9:41 pm
Ken,
There is even a lot more to it all then you expose as I have set out extensively on my blog at
http://au.360.yahoo.com/profile-ijpxwMQ4dbXm0BMADq1lv8AYHknTV_QH
The danger we are facing however is that as much the denial of DUE PROCESS OF LAW (that is within the confinement of constitutional provisions) and not as to what politicians make from it, can hit anyone.
As my blog sets out if DUE PROCESS OF LAW as provided for by the constitution as intended by the Framers of the Constitution had been all along applied we would never had cases like Vivian Alvarez Solon, Cornelia Rau and hundreds of others.
No wonder Philip Ruddock who was responsible for the Vivian Alvarez Solon debacle as Attorney General once again goes of the road of JUSTICE.
This is not an issue as to if Dr. Haneef is GUILTY or not as charged but about the extraordinary unconstitutional manner Australian Federal Police and the Federal Government has been pursuing matters.
As to the release of information by Stephen Keim QC, I see nothing wrong with this as I did likewise so before a criminal trial, in fact published it a book and then filed the book as evidence in the trail (and won the case)!
July 18th, 2007 at 11:30 pm
Enemy Combatant, jeff & Lotharsson…a nod to you all. There’s a big story out there…& the likes of Andrew Denton’s guests might like to tell us otherwise, but i guess keeping a lid on it suits the Gatekeepers & Steadiers of our society. I think the fear of Anarchy & the West being undermined as an Empire…& the desire to retain ‘privilege & power’ built up over yonks is a part of it…tho interestingly, new money has a great deal to do w/ it also:
(A must read at: http://www.nytimes.com/2007/07/15/business/15gilded.html?_r=1&th&emc=th&oref=slogin)
As Keating stated emphatically, the use of the term “Elite’ is lazy (particularly as Herr Howard & Herr Murdoch’s media use the term & how they apply it)…but moving on from their purile definition…the idea that The Ruling Class are one homogeneous group is incorrect…a number of factions & individual rebels exist…& alliances…various ideological beliefs ensure chasms exist. The above article reveals some of the differences based on Tax (views on the ‘trickle down effect’ & the Free Market…etc)…
Clinton under pressure (think back to the blackmail & Impeachment) was probably trying to ensure a number of ‘fair-goers’ rose to the top quickly off the dot.com boom…whilst knowing full well the Wolf Pack would also gain enormous capital, assets & benefits from this decision to revoke Glass-Steagall. A risk indeed.
And now TITANS fight. And who has Odin on their side? And who will be trampled under foot in the process? I think we already know some. Look to Iraq…the victims of 9/11…Katrina…Gaza…Lebanon…Israel…Bali…London…the list goes on…
It becomes more obvious to me by the day why the media of all kinds tries to denigrate Truth Seekers by referring to them as ‘conspiracy freaks’ & ‘tinfoil hatters’…i imagine the lads at the NY Times & Washington Post investigating the Watergate Affair were called similar on occasion. These fiends & their Enablers might try to muddy the waters…but eventually the World’s eyes will SEE…then, it is up to them, the PEOPLE, to decide if they want their World to Wobble & for Justice to be done.
We are the Speakers. Speakers for the Dead.
(borrowing of course from Orson Scott Card…’Ender’s Game & the rest of the series are a must read…talk about indoctrination, Big Brother & BSing your children…phew!)

So Tim has a post up at Blogocracy largely about 9/11 conspiracy theories being most unhelpful to progressive causes.
Which is largely true, but it’s also throwing the baby out with the bathwater which no doubt pleases some powerful people no end…
This inspired me to write three or four substantial comments pointing out that many possibilities should not be eliminated merely because we think “they’d never do that” (a real mind-opening maneuver once you cast off that delusion), and suggesting the physics don’t seem to provide strong support for the official story.
Assuming they get published, you never know - one or two readers might be encouraged to think a little deeper than the happy media narrative that purports to explain it to the unthinking consumer.
Well, one can dream, right?
July 19th, 2007 at 3:46 am
Well, he’s entitled to his opinion. As is Monbiot. And Tim has been patient considering this is not up his street. But I’d love to see the Left win w/out the so called ‘conspiracy theorists’?…& those who don’t see themselves as conspiracy theorists but Truth Seekers…;)…but then, how often have we seen the Centrists & major parties stab their minority allies in the back when they think they can taste victory? C’est la vite! (not referring to Tim here)
And i find it interesting that some bloggers don’t mind utilising somewhat conspiracy ideas & theories now & then when it suits them…;)
But i might add, I can see part of Tim’s point…as for the blowing up of the World Trade Center & the crash into the Pentagon, I tend to go w/ the official version…generally…but i do believe that certain people in the administration knew that an event was coming…& looked the other way.
I hope i’m wrong. But it sure fit snugly into their visions & goals.
I totally agree Lotharsson. ‘Intentional negligence’ & ‘false flag events’ have been proven time & time again…it’s all part of the ’shock & awe’ of ideologically driven campaigns.
Be interesting to find out how the mainstreamers define collusion between Government & the media…&/or the ‘intentional distorting & sexing up of evidence’ to convince a population they should go to War?
In the long run most people would prefer to believe that parts of the US administration weren’t going for a prolonged War in Iraq…that they didn’t send out US dollars to be passed on to militias & mercenaries that would lead to a ramping up of sectarian violence…that there is no secret, under-handed recruitment drive in Australia & the USA (compulsory service/the draft/conscription by the backdoor)…& that in the long run its just a bunch of occasionally incompetent, somewhat intelligent, but a little sneaky bunch of politicians makin’ their way thru Life & sometimes they make bad decisions & screw up. Fair enuff.
But me…i reckon greed, power & privilege can lead to some dreadful acts of collusion & plans…including The Holocaust…& the kind of stuff we’re seeing selectively coming out of the CIA’s files…tho i’m sure a few things are being held back because the public “can’t handle the truth”…& other reasons.
Anyhow, i’m still voting for Rudd…i’ll go w/ the Titans that are kinda Leftish…;)…& as for conspiracy type stuff, i’ll hold off…I get the not so subtle hint. Besides, juicy stuff about Costello & Howard comin’…:)
Now, what’s a conspiracy & what’s not…again?
