Consider the ridiculousness of this situation. Kevin Rudd wrote to the Cole Inquiry asking that it seek to extend its terms of reference so it could investigate whether anyone in the government had breached their obligations in regard to the AWB bribery allegations.
Those representing Mr Cole wrote back and said:

With his poll numbers in the gutter, a majority of the American people opposed to nearly everything he now does and concerned about his incompetence, his staff resigning, some of his senior party members under indictment or the threat of it, and having no chance (constitutionally) of being reelected, I guess it is hardly surprising […]
